Death Reviews
The Mental Hygiene Law [MHL 45.15,17], requires the Commission to review all deaths of patients/clients in State-operated or licensed mental hygiene facilities, and, where appropriate, conduct investigations of unusual or unnatural deaths. The Commission's Mental Hygiene Medical Review Board (MHMRB), which consists of up to 15 volunteer physicians (including specialists in forensic pathology, psychiatry, surgery, and internal medicine) appointed by the Governor, assists the Commission in these investigations by reviewing and making recommendations for improving clinical services in facilities subject to oversight by the Commission.
Reporting Requirements
Every director or person in charge of a mental hygiene facility must report to the Commission immediately, and in any event within three working days, the death of a patient or resident of any such facility [Mental Hygiene Law §45.19].
